Data Processing Agreement (DPA)
This DPA is an integral part of QwikEat Ltd Merchant Terms & Conditions.
1. Purpose
This agreement defines the conditions under which QwikEat processes personal data on behalf of the Merchant.
2. Nature and purpose
Technical processing necessary for providing the SaaS digital ordering service.
3. Documented instructions
QwikEat processes data only on the Merchant's documented instructions.
4. Security
QwikEat implements appropriate technical and organizational measures to ensure the confidentiality, integrity, and availability of data.
5. Subprocessing
The Merchant authorizes QwikEat to use subprocessors, subject to equivalent safeguards.
6. Data breaches
QwikEat notifies the Merchant of any personal data breach as soon as possible.
7. Assistance
QwikEat assists the Merchant in handling GDPR requests and security obligations.
8. Payment data
Payment data never passes through QwikEat. The payment provider is chosen and managed by the Merchant.
9. End of contract
At the end of the contract, data is deleted or returned according to the Merchant's instructions, unless otherwise required by law.
